These Terms & Conditions (“Terms”) govern your access to and use of the Refyn website and AI-powered resume-tailoring service (the “Service”), provided by Refyn (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated by reference.
2. Eligibility
You must be at least 16 years old and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that the information you provide is accurate.
3. Description of the Service
Refyn helps you tailor your resume to specific job descriptions through a guided, AI-assisted process. The Service uses third-party AI providers to analyze, suggest, and generate content. Output is generated automatically and may contain inaccuracies (see Section 9).
4. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us promptly of any unauthorized use. We are not liable for any loss arising from your failure to safeguard your credentials.
5. Subscriptions, Billing, and Cancellation
- Plans and trials. The Service may be offered on a free trial and on paid subscription plans (for example, weekly, monthly, and three-month plans). The trial period and plan details are presented at the point of sign-up or purchase.
- Billing. Paid subscriptions are billed in advance through our payment processor, Stripe, using the payment method you provide. By subscribing, you authorize us and Stripe to charge that method for the applicable fees.
- Automatic renewal. Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date.
- Cancellation. You may cancel at any time. Cancellation takes effect at the end of the current billing period, and you will retain access until then.
- Refunds. Except where required by law, fees are non-refundable and there are no refunds or credits for partial periods.
- Price changes. We may change our fees. We will give you reasonable advance notice of any price change, which will take effect on your next billing period.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful or fraudulent purpose;
- Submit content that is false, misleading, infringing, or that you do not have the right to submit;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Interfere with or disrupt the Service, including by overloading, scraping, or reverse-engineering it; or
- Use the Service to build a competing product or to resell its output without authorization.
7. Your Content and License
You retain all ownership of the resumes, job descriptions, and other content you submit (“Your Content”). You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and transmit Your Content solely to operate and provide the Service to you — including sending it to our AI providers to perform tailoring. This license ends when you delete Your Content or close your account, except for residual copies retained as described in our Privacy Policy. You are responsible for ensuring you have the right to submit Your Content.
8. Intellectual Property
The Service, including its software, design, and branding, is owned by us and protected by intellectual-property laws. Except for Your Content and the tailored output generated for you, these Terms do not grant you any right to our intellectual property. You may use the tailored resumes generated for you for your own personal job-search purposes.
9. AI-Generated Output Disclaimer
The Service uses artificial intelligence to generate suggestions and content. AI output may be inaccurate, incomplete, or unsuitable for your circumstances. You are solely responsible for reviewing, verifying, and editing all output before using it. We do not guarantee any particular result, including interviews, job offers, or employment outcomes. The Service does not provide legal, career, or professional advice.
10. Third-Party Services
The Service relies on third-party providers (including AWS, Anthropic, OpenAI, Stripe, and Sentry). We are not responsible for the availability, accuracy, or practices of these third parties, and your use of their services may be subject to their own terms.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
12. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.
13. Indemnification
You agree to indemnify and hold harmless Refyn from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms.
14. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe it is necessary to protect the Service or other users. Upon termination, the provisions that by their nature should survive (including Sections 7–13 and 15) will continue to apply.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Florida will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction in those courts.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
